CALL TO ORDER

                Village President Gary Phillips called the meeting to order at 7:00 p.m.  Present were President Phillips, Cami Myers-Alstat, Terry Gerber, and Nikki Tuffree.  Also present were Nick Bubolz from Town & Country Engineering, Attorney Michael Oellerich, Jack McDermott, Chief Brian Raupp, DPW Director Nick Todd, and Clerk Sherri Waege.  Absent were Jason Knox, Tina Suiter-Meyers, and Beth Schmidt.

AGENDA VERIFICATION

                Clerk Waege verified that on November 19, 2022, copies of the agenda were delivered to the President and Trustees; and posted at the Village Hall, Library, and the Orfordville Post Office.  There were no additions made to the agenda.

MINUTE APPROVAL

                Motion by Gerber, seconded by Tuffree to approve the November 8, 2022 Regular Board Meeting.  Motion carried.

CITIZENS WISHING TO BE HEARD

                None.

PUBLIC HEARING FOR THE 2022 GENERAL FUND BUDGET

                Open Public Hearing.  President Phillips opened the Public Hearing for the 2022 General Fund Budget at 7:02 p.m.  There were no citizens present.  Department Heads present did not indicate any concerns.   There were no changes to the budget since the last meeting.

                Close Public Hearing.  President Philips closed the Public Hearing for the 2022 General Fund Budget at 7:04 p.m.  

                Approve 2022 General Fund Budget. Motion by Tuffree, seconded by Gerber to approve the 2022 General Fund Budget for $1,424,402.00.  Motion carried.

                Approve the 2022 Tax Levy.  Motion by Gerber, seconded by Tuffree to approve the 2022 tax levy for $702,816.00.  Motion carried.

VILLAGE PRESIDENT’S UPDATE

                President Phillips explained that the paving project in the Village is complete.  The annual Shop Small event is this Saturday, November 27th, which is a day to support local businesses.  President Phillips added that Santa Clause will be at Molly’s Creations that day.  President Phillips reminded everyone that the annual Lions Club Holiday Parade will be on Saturday, December 4th.

NEW BUSINESS

                Developers Agreement for Lot 1 for Megan’s Properties LLC.  Jack McDermott was present and requested more time for the project.  McDermott explained that the cost and availability of materials has created a delay.  McDermott added that they amended the foundation plan due to the cost of materials, which required a review from the State which also delayed the project.  Tuffree asked when McDermott planned to start.  McDermott explained that his contractor is working on different jobs now that he had to wait for the state to approve his foundation revisions.   McDermott further explained that he would rather wait until spring to start.   Motion by Tuffree, seconded by Gerber to have Attorney Oellerich amend the Developers Agreement with Megan’s Properties LLC to require a start date of March 31, 2022, a required project completion date of December 31, 2022, and to impose a $3,000.00 penalty if the dates are not met.  Motion carried.

                Developers Agreement for a portion of 702 W. Brodhead Street.   Attorney Michael Oellerich explained that he does not know of a provision that the Village Board could add to the Developers Agreement that would guarantee that the Village would get the commercial building after the storage sheds are built.  Attorney Oellerich explained that a large financial penalty could be added but that would not likely be agreed to or paid if it was.   Clerk Waege will email the Voekel’s and let them know that the Village is not going to pursue the Developer’s Agreement as there is no way to guarantee the second building will be built.  No action taken.

                Sludge Pumps at the Wastewater Treatment Plant.   DPW Director Todd explained that the sludge pumps are getting old and having maintenance issues.   DPW Director Todd further explained that the pumps, as far as he can tell, are from when the plant was built in 1980 and were not replaced as part of the upgrade project.  DPW Director Todd explained that there is infrastructure money available in one of the Village’s accounts at the Local Government Investment Pool to pay for the new pumps.  Motion by Tuffree, seconded by Myers-Alstat to approve the bid from Waste Corp for two new pumps for a total of $49,000.00.  Motion carried.

                Track Loader.  DPW Director Todd explained that the department has a trade in rotation for the Bobcat, 2022 is the year for the trade in.  DPW Director Todd explained that the tracks for the current Bobcat split while it was being driven down the road.  DPW Director Todd explained that he contacted his representative at Bobcat and they would not cover the tracks under warranty, nor would they come out and look at the tracks.  DPW Director Todd explained his frustration as the tracks are expensive and had less than 40 hours of use on them.   DPW Director Todd explained that he has a price from Bobcat and John Deere for replacement for the 2022 planned trade in.  DPW Director Todd explained that the employees in the department preferred the John Deer over the Bobcat.  The trade in price with Bobcat is $17,943.56, the price for the John Deere is $16,581.12.  The existing Bobcat attachments will work with the John Deere model.  DPW Director Todd explained that it is likely that Rural Development unused grant money will pay for the new machine, he will have better numbers next year.   DPW Director Todd further explained that the machine will not be delivered until August 2022.  Motion by Tuffree, seconded by Gerber to purchase the John Deere for the scheduled upgrade for $16,581.12.  Motion carried.

                2022 Street and Utility Projects.   Nick Bubolz from Town & Country Engineering was present to explain the street upgrade plans for 2022.  These projects will be paid for with the borrowing package that was completed in 2021.   Bubolz and DPW Director Todd explained the following projects:  N. Center Street, the lower portion of S. Richards Street, storm sewer upgrades on Walnut Street and the S. Richards Street intersection, the intersection of N. Mowe Street and E. Church Street, paving the village garage parking lot, and bump outs for the downtown retail block.   Bubolz will send Clerk Waege the publication so it can be published for bids.

                Pay Request for 2021 Paving Project.   Bubolz explained the pay request from Rock Road for $492,026.55. Bubolz explained that there are a few other smaller items that need to be completed that are not included with this pay request.  Motion by Tuffree, seconded by Myers-Alstat to approve the pay request for Rock Road for $492,026.55.  Motion carried.

TREASURER REPORT

                Motion by Gerber, seconded by Myers-Alstat to approve the October Treasurer Report.  Motion carried.

VOUCHERS

                Motion by Tuffree, seconded by Gerber to approve the Vouchers for $23,723.36, check range of 33835-33857.  Motion carried.

CLOSED SESSION

                Motion by Tuffree, seconded by Gerber to go into closed session at 8:27 p.m. pursuant to Wisconsin State Statutes 19.85(1)(g) to confer with legal counsel for the governmental body who is rendering oral or written advice concerning strategy to be adopted by the body with respect to litigation in which it is or is likely to become involved-specifically to discuss the undeveloped portion of N. Maple Street that is being used by the owner of the property at 604 N. Maple Street.  Roll Call Vote- Myers-Alstat, Gerber, Tuffree, and President Phillips-all YES.  Motion carried.

RECONVENE

                Motion by Tuffree, seconded by Gerber to reconvene into open session at 9:25 p.m.  Roll Call Vote-Myers-Alstat, Gerber, Tuffree, and President Phillips-all YES.  Motion carried.

                No action was taken on items discussed in closed session.
