CALL TO ORDER

                President Dennis Burtness called the meeting to order at 7:00 p.m.  Present were President Burtness, Chuck Boyce, Beth Schmidt, Cami Myers-Alstat, Nikki Tuffree, Terry Gerber, and Jason Knox.  Also present were Attorney Mike Hahn, Nick Bubolz from Town & Country Engineering, Fredd Carr,  David Olsen, Librarian Sarah Strunz, Chief Jeremiah Burdick, DPW Director Nick Todd, and Clerk Sherri Waege.

AGENDA VERIFICATION

                Clerk Waege verified that on December 9, 2022, copies of the agenda were delivered to the President and Trustees; posted at the Village Hall, Library, Post Office, and the Bank of Brodhead. There were no additions made to the agenda.

MINUTE APPROVAL

                Motion by Gerber, seconded by  Tuffree to approve the November 28, 2022 minutes.  Motion carried.

NEW BUSINESS

                Amend Ordinance 304-34( C)(1) to operate on State Highway 213-item was moved up on the agenda.   Discussion was held on allowing ATV/UTV’s on State Highway 213.   Schmidt explained that the former Police Chief was not in favor of allowing the ATV/UTV’s  on State Highway 213.  Chief Burdick explained that he now has a good grasp on the speeding issue on Highway 213 and is comfortable with allowing ATV/UTV’s on Highway 213.  Tuffree explained that she spoke with Chief Burdick and Interim Fire Chief Ryan Perkins and neither one had an issue with it.  President Burtness explained that he wasn’t involved when the ordinance was created.  President Burtness further explained that he is pleased with how things are going with the ATV/UTV’s in the Village and has no issue with it. Gerber explained that prohibiting ATV/UTV’s on Highway 213 felt like the right thing to do at that time. 

                Motion by Gerber, seconded by Boyce to amend Ordinance 304-34(C)(1) by allowing ATV/UTV’s to drive on State Highway 213 within the Village limits of the Village of Orfordville , subject to approval by the Department of Transportation.  Roll Call Vote-Boyce, Schmidt, Myers-Alstat, Tuffree, Gerber, Knox, and President Burtness-all YES.  Motion carried.   Knox will provide the paperwork to Clerk Waege to submit to the Department of Transportation.  Knox will also order the signs which will be paid for by the ATV/UTV club.  Tuffree added that the signs have to be up before ATV/UTV’s can drive on Highway 213. 

                Amend Ordinance 304-34(D)(7) to Change the Hours of Operation of ATV/UTV’s on streets.  President Burtness explained that he received a request to change the ordinance which currently allows ATV/UTV’s on streets from sunrise to sunset.   Myers-Alstat asked if the request was for a specific time.  Chief Burdick explained that he would be ok to allow them from 7:00 a.m. to 10:00 p.m.  President Burtness compared them to a snowmobile which does not restrict hours.  President Burtness added that snowmobiles are very loud as well. 

                David Olsen was present and explained that 7:00 a.m. was late if a person was going hunting.   Olsen further added that the ATV/UTV’s are not as loud as Harley Davidson motorcycles which are not restricted.

                Nick Howard suggested 4:00 a.m. to accommodate hunting.

                Motion by Tuffree, seconded by Schmidt to amend ordinance 304-34(D)(7) to allow ATV/UTV’s  to drive between the hours of 5:30 a.m. and 10:00 p.m.   Roll Call Vote-Schmidt, Myers-Alstat, Tuffree, Gerber, and President Burtness-YES, Boyce and Knox-NO.  Motion carried.

                Recommendation for Rate Increase Study for the Water Utility.  Clerk Waege explained that she is having an issue with finding a firm to do it.   Nick Bubolz explained that he may have a couple of contacts.  Motion by Tuffree, seconded by Gerber to table to the January 9, 2022 meeting.  Motion carried.

                Pay Request #3 for Rock Road.  Nick Bubolz explained that this is the final pay request for Rock Road. The amount due is $13,944.89 which is the retainage for the project.  Motion by Boyce, seconded by Myers-Alstat to approve pay request #3 for Rock Road for $13,944.89.  Motion carried.

                Surplus Public Works Equipment.   Motion by Knox, seconded by Boyce to authorize DPW Director Nick Todd to sell the street sweeper (as is), a set of skid steer tires, and an old playground set on Wisconsin Surplus.   Motion carried.   DPW Director Todd explained that one resident reached out to him about purchasing the street sweeper. DPW Director Todd will let the resident know where it will be sold online.

                Fire Protection Agreement.  Attorney Mike Hahn was present and explained the revised agreement for the Orfordville Fire District which includes the Village of Orfordville, the Town of Plymouth, the Town of Newark, a portion of the Town of Avon, and a portion of the Town of Spring Valley.   Discussion was held on what happens in the event that the Town of Newark does not approve the budget on December 19th.   Attorney Hahn explained that the budget would have to be revised.  

Discussion held on adding language to the agreement to allow the previous years budget to be the base moving forward.   Additional discussion held on how to prevent one municipality from controlling how the rest of the district can operate.  

                Motion by Myers-Alstat, seconded by Tuffree to authorize President Burtness and Attorney Mike Hahn to go back to the fire commission with the Draft Agreement with the following revisions:  add language that the Fire Commission can rely on the previous years budget as a base budget and to add language that allows for detachment for a municipality that fails to approve their budget.   Roll Call Vote- Boyce, Schmidt, Myers-Alstat, Tuffree, Gerber, Knox, and President Burtness-all YES.  Motion carried.

DEPARTMENT HEAD REPORTS

                Motion by Tuffree, seconded by Gerber to approve the Department Head Reports.  Motion carried.

VOUCHERS

                Motion by Tuffree, seconded by Schmidt to approve the vouchers with a check range of 35143-35192.  Motion carried.

ADJOURN

                Motion by Knox, seconded by Tuffree to adjourn at 8:40 p.m.  Motion carried.
