CALL TO ORDER
President Gary Phillips called the meeting to order at 7:00 p.m. Present were President Phillips, Tina Suiter-Meyers, Beth Schmidt, Cami Myers-Alstat, Terry Gerber, Nikki Tuffree, and Jason Knox. Those present that addressed the board were Attorney Michael Oellerich, Chief Brian Raupp, Andrew Hauck, Terry Morris, and Clerk Sherri Waege.
AGENDA VERIFICATION
Clerk Waege verified that on June 25, 2021, copies of the agenda were delivered to the President and Trustees; and posted at the Village Hall, Library, and the Orfordville Post Office. There were no additions made to the agenda.
MINUTE APPROVAL
Motion by Gerber, seconded by Tuffree to approve the June 14, 2021 minutes. Motion carried.
CITIZENS WISHING TO BE HEARD
Terry Morris of 601 E. Church Street was present. Morris asked about the details of the ATV/UTV ordinance. President Phillips explained that Morris could address the board under Citizens Wishing to be Heard as there will be no rebuttal during the ordinance discussion. Morris explained that he was here to discuss it, but it was hard to do without knowing the details of the ordinance. President Phillips explained that the board received the ordinance draft this afternoon. Morris explained that the DNR website provides a twenty-five page document on rules for ATV/UTV’s. Morris added that ATV/UTV’s also have to follow the motor vehicle rules. Morris added that he felt that the rules were in place by the state, and it appears that the Village is adding more rules than necessary.
President Phillips explained that the village agreed to hold an advisory referendum in April. The election had a 28% turnout and the referendum passed by a slim margin of twelve votes. President Phillips added that the ordinance that is being drafted has to make everyone happy and that everyone has to be able to live with it. Morris agreed but added that it is hard to debate it if the public isn’t aware of what it is.
President Phillips explained that the ordinance will be reviewed when the item on the agenda is discussed.
UNFINSIHED BUSINESS
President Phillips moved the ATV/UTV item down in the agenda order so the shorter items could be taken care of first.
Agreement with the owner of 108 N. Center Street to use a portion of Village Land. President Phillips explained that he was approached by Kevin Lloyd, the owner of 108 N. Center Street, who asked to be able use a small square portion of adjoining land owned by the village that is located on the corner between the East and North parking area. President Phillips explained that the Lloyds may want to put a shed on the land in the future. Attorney Oellerich explained that the Lloyds would have to go through the variance process for a shed, as based on the size of the village land, there will most likely be an issue with the setbacks. Motion by Gerber, seconded by Schmidt to approve the use of the property for Kevin Lloyd and that a shed, if applicable, would have to go through the variance process. Motion carried.
NEW BUSINESS
Ordinance amendment for permits for pools, fences, and accessory buildings. Clerk Waege explained that this item was requested by the building inspector who was not present. Motion by Knox, seconded by Gerber to table to the July 12, 2021 meeting. Motion carried.
UNFINISHED BUSINESS
ATV/UTV Ordinance. Attorney Michael Oellerich reviewed the draft of the ordinance. Attorney Oellerich explained that the ordinance draft is based on what was requested at the meeting on May 24, 2021.
Myers-Alstat explained that she researched other ordinances since the last meeting. Myers-Alstat explained that the ordinances she reviewed did not have the ten mile an hour speed restriction. Myers-Alstat explained that one of them allowed speeds of 15-25 miles an hour, and the other stated that speeds could not exceed 25 miles an hour. Schmidt explained that she too was concerned with the safety issue of the ten mile an hour speed limit. Attorney Oellerich explained that the ordinance could be changed to say no person could exceed 25 miles an hour and that speed limits have to be followed as designated.
Attorney Oellerich explained that there was discussion on having a preferred route at the last meeting. Attorney Oellerich advised the board that preferred is a preference and not enforceable in the ordinance.
Knox asked about the date in Section 3 that limits drivers based on age. Knox wanted to clarify if the Village was going to go by December 31, 1987 in the ordinance or January 1, 1988 which is in the DNR rules. Chief Raupp explained that the Footville ordinance says December 31, 1997. The board will leave it at December 31, 1997.
Morris asked about the restriction that prevents ATV/UTV riders from driving on Highway 213. President Phillips explained that the Police Chief was against driving on Highway 213 due to the vehicle speeds. Morris explained that it would be hard to get across town if you can’t go down the highway. President Phillips explained that you can cross Highway 213 but can’t drive down it.
Andrew Hauck of 110 N. Center Street explained that he would be concerned with the driving in the school zone on Church Street. President Phillips explained that it wouldn’t be any different than the motorcycles that speed in that area.
Tuffree asked about the timeline for moving forward. Chief Raupp explained that Footville approved their ordinance in March, and that the signs went up last week. Attorney Oellerich explained that the timing depends on when the ordinance is posted and when the signs go up. Knox explained that the next ATV/UTV meeting will be on July 14, 2021. Attorney Oellerich explained that he will get with Knox regarding drafting an agreement with the ATV/UTV club for sign posting. Attorney Oellerich will bring the agreement and revised ordinance to the board meeting on July 26, 2021.
Motion by Tuffree, seconded by Schmidt to table to the July 26, 2021 meeting to allow time for the speed limit change to be changed in the ordinance, and to allow time for an agreement with the ATV/UTV Club to be drafted to determine signage responsibilities and requirements. Motion carried.
TREASURER REPORT
Motion by Gerber, seconded by Myers-Alstat to approve the May Treasurer Report. Motion carried.
VOUCHERS
Motion by Knox, seconded by Suiter-Meyers to approve the following vouchers: 33290-33293 for $6,599.92 and 33284-33341 for $21,570.94. Motion carried.
ADJOURN
